Buma wil andere online muziekmarkt

De collectieve rechtenorganisaties Buma en Sabam (België) hebben het initiatief genomen om te komen tot een nieuwe markt voor online muziek. Buma en Sabam hebben zich verbonden onderling geen overeenkomsten aan te gaan die de mededinging beperken. In het bijzonder zullen zij licentienemers niet de verplichting opleggen gevestigd te zijn in het land waar de rechtenorganisatie een online licentie verstrekt. Als gevolg hiervan kan een Belgische bedrijf een licentie van Buma krijgen en andersom.


In het verleden maakten dergelijke restricties standaard onderdeel uit van de overeenkomsten die de rechtenorganisaties onderling sloten. De zgn. Santiago agreement creëerde op deze wijze een internationale markt voor online muziek. Op basis hiervan kon bij één organisatie een wereldwijde licentie worden verkregen. De Europese Commissie had echter ernstige mededingingsrechtelijke bezwaren tegen de landenclausule. Vanaf 31 december 2004 was de Santiago agreement dientengevolge niet meer van kracht en moesten online muzieksites in alle landen afzonderlijk een licentie verkrijgen.


“The Commission strongly supports the “one-stop shop” EEA-wide copyright licensing for legitimate online Internet music services and which include the music repertoires of all societies as foreseen in the so-called Santiago Agreement. It fully acknowledges the need to ensure adequate copyright protection and enforcement against piracy. However, it considers that the restrictions created by the “economic residency clause”, which implies that users can only obtain EEA-wide licences for the online use of music from their national collecting society, may infringe Article 81 of the EC Treaty, as the territorial exclusivity afforded to each of the participating collecting societies is not justified by technical reasons and is irreconcilable with the reach of the Internet.


BUMA and SABAM commit not to be party to any agreement containing an “economic residency clause”. The commitments are published in the Official Journal, so that interested third parties may submit observations prior to the Commission making, by decision, the commitments binding on these two collecting societies.”
